Abstract
Darbā tiek analizēts iekšējās pārliecības kā pierādījumu novērtēšanas kritērija funkcionēšana un mijiedarbība ar citiem pierādījumu novērtēšanas sistēmas elementiem. Analizētas pierādījumu novērtēšanai raksturīgās iezīmes un saturs, skaidrota kritērija “iekšējā pārliecība” vieta pierādījumu novērtēšanas procesā.
Tālāk analizētas Latvijas Republikā spēkā esošās tiesību normas, kuras satur jēdzienu “iekšējā pārliecība”, noskaidrots šo normu saturs, kā arī tiesu prakse par šo tiesību normu piemērošanu. Definētas no iepriekšējo jautājumu analīzes izrietošās problēmas, aplūkotas iespējas tās novērst vai vismaz mazināt šo problēmu ietekmi. Darba nobeigumā apkopoti un izteikti no problēmu un jautājumu analīzes izrietošie secinājumi.
This diploma paper analyses the functioning of the criterion of internal belief and its interaction with other elements inherent in the system of evidence evaluation. The nature of the criterion of internal belief is elaborated upon and its place in the process of evidence evaluation is defined. As a result, the validity of defining internal belief as a criterion for evaluating is determined. It discusses existing applicable legal norms currently in force in the Republic of Latvia involving the concept of internal belief and elucidates the content of such norms and involves an analysis of court practice in applying and using in court activities such legal norms as prescribed. This paper defines problems arising from the analysis of the above issues and discusses the possibilities of eliminating such problems or at least of reducing their effects by proposing possible solutions. In conclusion, it enumerates and summarises the conclusions drawn from the analysis of inherent problems and issues.
