Abstract
Šī pētniecības darba galvenais mērķis ir sīkāk aplūkot salīdzinoši nesen Kriminālprocesa likumā iekļauto sadaļu attiecībā uz lietu izskatīšanu rakstveida procesā. Darbā autore pēta lietu izskatīšanu apelācijas instances tiesā rakstveida procesā iekļaušanu Kriminālprocesa likumā, iztiesāšanas norisi un iztiesāšanas īpatnības gan Latvijā, gan tās salīdzinot ar ārvalstu praksi, kā arī apkopos un analizēs tiesnešu sniegto viedokli attiecībā uz rakstveida procesa pielietošanu ikdienas darbā. Autore norāda uz nepieciešamību arī turpmāk pilnveidot likuma sadaļu, kas attiecas uz lietas izskatīšanu apelācijas instances tiesā rakstveida procesā, jo šī prakse Latvijā pastāv tikai nedaudz vairāk kā piecus gadus, kas pēc autores domām ir neliels laika posms. Gan apkopojot tiesnešu sniegto viedokli, gan autorei strādājot Rīgas apgabaltiesas Krimināllietu tiesas kolēģijā, ikdienā strādājot ar lietām, kuras tiek izskatītas rakstveida procesā, ir jāatzīst, ka rakstveida process neapšaubāmi paātrina krimināllietu izskatīšanas termiņus, kā arī samazina valsts resursu patēriņus, tomēr praksē pastāv nelielas nepilnības, kas pēc autores domām, laika gaitā ir iespējams novērst un pilnveidot. The main objective of this research paper is to thoroughly study the section, which was relatively recently introduced in the Criminal Procedure Law, inrelation to case hearing in written procedure. In the paper the author explores the inclusion of case hearing in the court of appellate instance in written proceedings in the Criminal Procedure Law, the adjudication process and peculiarities in Latvia and the ircomparison with foreign practices, as well as will collect and analyse the views of judges with regard to the use of the written procedure in daily work. The author points to the need to continue to develop these action of the law that applies to case hearing in the court of appellate instance in the written procedure, as this practice was introduced in Latvia only a little more than five years ago, which, according to the author, is a short period of time. As the result of gathering the views of judges and the author working in the Criminal Matters Board of the Riga Regional Court, every day dealing with cases heard in the written procedure, it must be acknowledged that the written procedure undoubtedly speeds up the pace of hearing criminal cases, as well as reduces the consumption of state resources, however, in practice, the reare slight imperfections which, according to the author, can be prevented and improved.
