Pamatvajadzību un pamattiesību nodrošināšanas problemātika likumpārkāpējiem ieslodzījuma vietās

Abstract
Brīvības atņemšanas soda būtība paredz personas tiesību ierobežojumus, taču tie nedrīkst pārsniegt soda izpildei nepieciešamo minimumu. Tomēr Latvija regulāri saskaras ar ieslodzīto sūdzībām par pamattiesību un pamatvajadzību nenodrošināšanu ieslodzījuma vietās. Bakalaura darba mērķis ir izpētīt, kāpēc un kādu tiesību aizskārumu dēļ, Latvija maksājusi kompensācijas ar brīvības atņemšanas sodu notiesātām personām.
Atkārtoti aizrādījumi no starptautiskām un nacionālām cilvēktiesību sargājošām institūcijām, kā arī tiesu prakse norāda uz nopietnām problēmām cilvēktiesībām atbilstošu uzturēšanās apstākļu nodrošināšanā Latvijas cietumos.
Nemainot situāciju ieslodzījuma vietās, Latvijai arī turpmāk nāksies maksāt kompensācijas ieslodzītajiem un negatīvi tiks iespaidota resocializācija. Lai to nepieļautu, ir nepieciešama nopietna esošo problēmu analīze un cilvēktiesībām pakārtota valsts budžeta līdzekļu sadale.
Deprivation of liberty entails limitations of certain fundamental rights, however they should not exceed the absolute minimum necessary for the execution of this punishment. Latvia receives numerous complaints from imprisoned persons alleging failure to ensure fundamental rights and needs. The main aim of this thesis is to examine why and for which violations of fundamental rights Latvia has disbursed compensations to persons deprived of liberty. Continuous reproaches from international and national human rights protection bodies as well as case law indicate substantial issues in Latvia’ s prisons with ensuring appropriate living conditions. Failure to improve these conditions will result in an increase of complaints from imprisoned persons and it will also negatively affect re-socialization. In order to prevent this, a thorough analysis of existing problems has to be carried out and resources of the state budget should be, first of all, allocated to the protection of human rights.
