Abstract
The title of the Master Thesis „The Interpretation of the General Clause „State and Public Interest” and its Relation to the Person’s Right to Property” has been chosen because of its topicality. The Constitutional Court has passed two decisions regarding breach of the paragraph 105 of the Constitution recently. The development of the appropriate understanding and correct adaptation of the general clause has to be continued for prevention of unreasonable limitation of person’s right to property. This is the only way for strengthening democratic structure of the state and society. Important aspect of the Thesis is research on genesis of the terms included in the general clause. Wide spectrum of literature and significant decisions of the European Court of Human Rights and the Constitutional Court have been used in developing this Thesis.
