Abstract
Bakalaura darba "Parādu piedziņas procesu veidi un aktualitātes" aktualitāte ir saistīta ar ievērojamo parādu piedziņas procesu skaitu palielināšanos pēdējā laikā. Strīdīgo jautājumu regulējošais spēks ir likumdošana, kas diemžēl nespēj nodrošināt problēmu risināšanu tādā līmenī, kā to prasa pašreizējā situācija valstī.
Bakalaura darbam autore izvirzījusi mērķi: ņemot vērā izveidojušos parādu piedziņas praksi, aplūkot un izanalizēt problēmas, kas rodas parādu piedziņas procesa gaitā, to rašanās cēloņus un sekas. Izvirzītā mērķa sasniegšanai darba autore veikusi parādu piedziņas procesu veidu analīzi, apskatījusi visbiežāk sastopamās problēmas, kas rodas parāda piedziņas procesa gaitā, un secinājusi, ka šo problēmu cēlonis galvenokārt ir parādu piedziņas procesu tiesiskā regulējuma trūkumi un nepilnības, kā arī šo tiesību normu deklaratīvais raksturs.
Veicot analīzi, darba autore secinājusi, ka:
-Latvijā nepieciešams ieviest atsevišķu ārpustiesas parādu piedziņas procesu regulējošu tiesību institūtu, kas papildus LR Civillikumā esošajām tiesību normām arī regulētu pašu piedziņas procesu, ļaujot aizsargāt ne tikai kreditora, bet arī parādnieka tiesības un tiesiskās intereses parāda piedziņas procesa gaitā;
-Šobrīd pastāvošie parādu piedziņas procesu veidi - saistību bezstrīdus piespiedu izpildīšana, saistību piespiedu izpilde brīdinājuma kārtībā un parāda piedziņa prasības kārtībā - pārsvarā spētu nodrošināt pienācīgu un tiesisku parādu piedziņas praksi, taču tiesību normu godprātīgu un labticīgu izmantošanu un piemērošanu atbilstoši to mērķim traucē zemais tiesiskās apziņas līmenis, kā dēļ būtu nepieciešams stingrāks tiesiskais regulējums.
Bakalaura darbs sastāv no ievada, trim nodaļām, kopsavilkuma, izmantotās literatūras un normatīvo aktu saraksta, kā arī satur pielikumus.
Bakalaura darba gaitā darba autore izdarījusi vairākus secinājumus un sniegusi vairākus piedāvājumus, kā uzlabot parādu piedziņas procesu Latvijā.
Bachelors’ Diploma “Forms and topicality of Debt recovery processes” actuality is associated with increased numbers of substantial Debt recovery processes in present moment. A contentious issue regulates by the law force, which unfortunately can not provide problem solving at a level which is required by the current situation in the country. Authoress has set a target of Bachelor’s Diploma: considering of established Debt recovery practices, to view and analyze the problems arising from the Debt recovery process, occurrence of the causes and consequences. To achieve the goal, Authoress has analyzed Debt recovery processes, considering the most common problems arising from the Debt recovery process, and concluded that the problem reason mainly is regulatory gaps in a Debt recovery processes and its weaknesses, as well as declarative nature. During the analysis, Authoress concluded that: - It is necessary to introduce in Latvia certain “out- of- Court” Debt recovery process regulation in the Institute of Civil Law in addition to existing laws and regulation recovery process, allowing not only to protect the Creditor but also the Debtor's rights and legitimate interests in debt recovery process; - The existing Debt recovery process types – commitments on a no contestation basis implementation, liability enforcement of warning and Debt collection requirements of the order – usually are able to provide proper and legal Debt recovery practices, but the provision of fail and bona fide use and application according to their objective disturbed by the low legal awareness level, which would require more stringent rules. Bachelors Diploma consists of an introduction and three chapters, the summary, the list of applied literature and legislation, it also contains the annexes. During Bachelors Diploma development the Authoress has made a number of conclusions and made several offers to improve the Debt recovery process in Latvia.
