Abstract
Bakalaura darbs ,,Pierādījumu pieļaujamība kriminālprocesā” sniedz ieskatu pierādījumu jēdzienā, saturā un pierādījumu pazīmēs. Izpēta pierādījumu pieļaujamību un ar to saistītās problēmas, absolūtās pierādījumu nepieļaujamības gadījumus, ierobežotās pierādījumu pieļaujamības gadījumus. Pētot pierādījumu pieļaujamību, absolūto pierādījumu nepieļaujamību un ierobežoto pierādījumu pieļaujamību, analizēti tiesībzinātnieku viedokļi un tiesu prakse, apzināti problēmjautājumi un sniegti ieteikumi to risināšanai. Darba mērķis ir izprast pierādījumu jēdzienu un tā saturu, sniegt ieskatu pierādījumu pazīmēs, izpētīt pierādījumu pieļaujamības izpratni, pierādījumu absolūtās nepieļaujamības gadījumus, pierādījumu ierobežotās pieļaujamības gadījumus, “saindētā koka augļu” doktrīnu, kā arī izpētīt pierādījumu ieguves pamatotību, izmantojot operatīvās darbības; sniegt ieskatu Eiropas Savienības regulējumā par pierādījumu savstarpēju atzīšanu un Eiropas Savienības dalībvalstu viedokli par tā pilnveidošanu. Darbā tiek sniegts autora viedoklis par problēmām, kuras saistītas ar pierādījumu pieļaujamību teorijā un praksē, kā arī autora piedāvājums likuma grozījumiem problēmu risināšanai. Analizējot problēmjautājumus, konstatētas nesaskaņas esošajā pierādījumu pieļaujamības regulējumā, nepieciešamība pēc atsevišķu Kriminālprocesa likuma pantu grozījumiem, problēmas ar pierādījumu pieļaujamības izvērtēšanu praksē. Bachelor thesis, Admissibility of evidence in criminal process" provides insight into the concept of proof, content and characteristics of evidence. Examines the admissibility of evidence and the problems related to it, examines cases of absolute inadmissibility of evidence and limited admissibility of evidence. In researching the admissibility of evidence, absolute inadmissibility of evidence and limited admissibility of evidence opinions of legal writers and case law was analyzed, issues were identified and recommendations to address them were made. The aim of this thesis is to understand the concept of evidence and its contents, to give insight on to the characteristics of evidence, to examine the admissibility of evidence, to examine the cases of absolute inadmissibility of evidence, to examine cases of limited admissibility of evidence, to examine the doctrine of “the fruit of the poisonous tree”, to examine the validity of extracting evidence through operational activities, to provide insight on the regulation of the European Union in the context of mutual recognition of evidence among member states of the European Union, as well as the views of some of the member states about this matter. In this thesis, the opinion of the author relating to the problems of admissibility of evidence in theory and practice and recommendations for amendments in regulation concerning these problems are provided. By analyzing the issues differences in the regulation of the admissibility of evidence were found, recognition for the need for amendments in separate articles in the Criminal procedure law was made, problems with evaluation of admissibility of evidence in the practice were found.
