Abstract
1980.gada Vīnes Konvencija par starptautiskajiem preču pirkuma-pārdevuma līgumiem (saīsināti CISG) ir veiksmīgs 20.gadsimta sākumā uzsāktās starptautisko tirdzniecības tiesību unifikācijas turpinājums, jo satur modernu, mūsdienu starptautiskās tirdzniecības prasībām atbilstošu regulējumu. Neskatoties uz to, CISG nav piemērojama universāli attiecībā uz visiem pasaules starptautiskajiem preču pirkuma līgumiem. CISG piemērošanas robežas ir konkrēti noteiktas, un CISG dalībvalstu tiesām šīs robežas ir pienākums ievērot. Praksē šis uzdevums nav viegls, jo CISG normas ir mērķtiecīgi formulētas ar augstu abstrakcijas pakāpi. Tomēr vairāku gadu CISG piemērošanas un izpētes rezultātā, tiesas un tiesību pētnieki ir nonākuši pie pareizām atziņām CISG piemērošanas jomā, un šī darba mērķis ir uz šo atziņu pamata izstrādāt CISG piemērošanas metodoloģiju.
1980 Vienna Convention on Contracts for the International Sale of Goods (CISG) is considered as a successful instrument of the international trade law unification movement dating back to the beginning of the 20th century. The CISG is drafted to satisfy the needs of international trade and it indeed does. Yet, its universal application to any contract for the international sale of goods is prohibited. Limitations on the application are determined in the CISG itself, therefore courts of the contracting states must not disregard them. In practice it might turn out to be rather difficult task, since provisions of the CISG are drafted abstractedly. Nevertheless, the CISG scholars and judges have managed to come up with some correct answers. The purpose of this paper is to create a methodology for the application of the CISG.
