Abstract
Šī pētniecības darba galvenais mērķis ir izpētīt krimināllietu tiesvedības īpatnības apelācijas instances tiesā. Darbā autore pēta krimināllietu iztiesāšanu apelācijas instances tiesā saistībā ar iesniegto apelācijas sūdzību vai protestu par pirmās instances tiesas pieņemto gala nolēmumu, aktuālos jautājumus, īpatnības un problēmas, kuras radušās sagatavojot lietas iztiesāšanai, iztiesāšanas gaitā, kā arī taisot nolēmumus. Autore darba gaitā apkopos un analizēs tiesnešu, tiesnešu palīgu, tiesas sēžu sekretāru, kā arī citu tiesas darbinieku sniegto viedokli attiecībā par tiesvedības īpatnībām, iztiesājot krimināllietas apelācijas instances tiesā. Autore norāda uz nepieciešamību pārskatīt vairākas definīcijas attiecībā uz krimināllietu iztiesāšanu apelācijas instances tiesā, jo pieejamā juridiskā literatūra, kas publicēta uz reiz pēc Latvijas neatkarības atjaunošanas, ir novecojusi un neatbilst Kriminālprocesa likumā norādītajam, kā arī ir jāņem vērā tiesu prakses attīstība laika gaitā. Gan apkopojot tiesnešu, tiesnešu palīgu un citu tiesas darbinieku sniegto viedokli, gan autorei strādājot Rīgas apgabaltiesas Krimināllietu tiesas kolēģijā par tiesas sēžu sekretāri, ikdienā strādājot ar tiesā ienākošajām krimināllietām, ir jāatzīst, ka nepastāv daudz problēmu vai jautājumu, kas būtu jānovērš un jāatrisina, tomēr praksē pastāv nelielas nepilnības, kuras pēc autores domām, laika gaitā ir iespējams novērst.
The main objective of this research work is to investigate the specific nature of criminal proceedings before the Court of Appeal. In her work, the author examines the trial of criminal cases before the Court of Appeal in connection with the appeal or protest brought against the final decision of the Court of First Instance, the topical issues, specifics and problems raised in the preparation of the proceedings for the hearing, in the course of the hearing, and in the making of judgments. In the course of the work, the author will gather and analyse the opinions of judges, assistant judges, secretary of court hearings, as well as other staff of the court, in the case of criminal proceedings before the Court of Appeal. The author points to the need to review a number of definitions regarding the adjudication of criminal cases at the Court of Appeal, since the available legal literature, published once after the restoration of Latvia's independence, is outdated and does not comply with the criminal proceedings law, as well as the development of judicial practice over time, should be taken into account. While compiling the opinion provided by judges, assistant judges and other court employees, the author works in the Riga Regional Court Criminal Court Board on the Registrar of the hearings, while working daily with criminal cases in court, has to admit that there are not many problems or issues that should be addressed and resolved, there are, however, minor shortcomings in practice, which, according to the author's time, it is possible to prevent and improve over time.
