Abstract
Absolūtie pamati preču zīmes reģistrācijas atteikumam un atzīšanai par spēkā neesošu ir uzskaitīti Latvijas likuma „Par preču zīmēm un ģeogrāfiskās izcelsmes norādēm” 6. pantā, atrodami Eiropas Savienības regulējumā un starptautiskos nolīgumos. Pamati ir uzskaitīti kodolīgi un koncentrēti, bet to saturs ir apjomīgs un plaši interpretējams. Tāpēc sarežģītākie jautājumi ir saistīti ar absolūto pamatu saturu, jēdzienisko izpratni, piemērošanas robežām un specifiskajām niansēm. Darba mērķis ir gūt absolūto pamatu saturisko izpratni, autorei vērtējot un analizējot gan likuma tekstu, gan zinātniskajā literatūrā un Eiropas Savienības tiesu praksē paustās atziņas. Autore pētnieciskā darba rezultātā nonāk pie secinājumiem, kas saprotams ar katru likumā minēto absolūto pamatu, liekot uzvaru specifiskiem aspektiem un izpratnes niansēm.
Absolute grounds for refusal and invalidation of trade mark registration are found in Latvian Law – „Law on Trade Marks and Indications of Geographical Origin” Section 6, as well as in European Union regulations and international treaties. Grounds are layed out in a concise and converging manner, but the content is extensive and widely interpreted. The most complex questions are those related to the meaning of and content of absolute grounds, scope of application and specific gradations and nuances when dealing with application. The objective is to understand the most significant aspects of absolute grounds by judging and evaluating the formal text of Law, and recognitions made in scientific literature and in judgements of European Court of Justice. Author comes to conclusions concerning specific gradations and nuances of absolute grounds as the result of the research work in thesis.
