Abstract
Maģistra darba tēma izvēlēta tās aktualitātes dēļ gan tiesību, gan politikas un ekonomikas jomās. Covid-19 krīze ir būtiski ietekmējusi uzņēmējdarbības vidi kopumā, tajā skaitā arī konkurenci. Maģistra darba ietvaros tiek pētīts, kāda ir ārkārtas stāvokļa laikā piešķirtā valsts atbalsta ietekme uz vienlīdzīgu konkurenci dalībvalstu uzņēmumu starpā, kā arī vai atbalsts neapdraud brīvu un godīgu konkurenci Eiropas Savienības vienotā tirgus kontekstā. Darba mērķis ir izpētīt valsts atbalsta regulējuma mijiedarbību ar iekšējo tirgu un netraucētu konkurenci bezprecedenta Covid-19 krīzes apstākļos un piedāvāt tiesiskā regulējuma uzlabojuma virzienus. Darba ietvaros tiek pētīts, kā Eiropas Savienības regulējums juridiski ievirza ekonomisko reakciju uz krīzi un kā krīze ietekmē Eiropas Savienības valsts atbalsta noteikumu interpretāciju attīstību un pilnveidi. Maģistra darbā izvirzītie uzdevumi ir izpētīt valsts atbalsta kritērijus un kontroli kontekstā ar netraucētu konkurenci, analizēt valsts atbalsta regulējumu un piemērošanas tendences Covid-19 krīzes apstākļos, kā arī pētīt Eiropas Savienības tiesas (turpmāk - EST) praksi, kurā izskatīta Covid-19 atbalsta pieļaujamība.
The topic of the master's thesis was chosen due to its topicality in the fields of law, politics, and economics. The Covid-19 crisis has had a significant impact on the business environment, including competition. The Master's thesis examines the impact of state aid granted during a state of emergency on equal competition between companies of the Member States, as well as whether the aid does not endanger free and fair competition in the context of the European Union's single market. The aim of the master's thesis is to explore the interaction between state aid regulation and the internal market and undistorted competition in the context of the unprecedented Covid-19 crisis, as well as to suggest directions for improvement of the legal framework. The work examines how the European Union regulation legally directs the economic response to the crisis and how the crisis affects the development and improvement of interpretations of the European Union state aid rules. The tasks of the master's thesis are to study the state aid criteria and control in the context of undistorted competition, to analyze the state aid regulation and application trends in the Covid-19 crisis, as well as to study the Court of Justice of the European Union cases, which examines the admissibility of Covid-19 aid.
