ACTA ietekme uz brīvu pakalpojumu sniegšanu un apriti digitālajā vidē Eiropas Saienības ietvaros

Abstract
Bakalaura darba mērķis ir izpētīt iespējamās normatīvās un institucionālās izmaiņas, kas skar brīvo pakalpojumu sniegšanu un apriti digitālajā vidē Eiropas Savienībā (ES), sakarā ar “Viltošanas novēršānas tirdzniecības nolīguma” (ACTA) parakstīšānu. Šis starptautiskais līgums ir izraisījis asas diskusijas un protestus visā pasaulē, kas pierāda šī darba temata un izpētes jautājuma aktualitāti.
Analīzē ir iekļauta vispārīga informācija par ES digitālo vienoto tirgu, e-komercijas regulējumu, apzīmētas tā problēmas, kā arī attīstības pamatnostādnes caur Digitālo programmu Eiropai. Analīze satur nolīguma noteikumu salīdzinājumu ar esošo regulējumu ES, Latvijas Republikas, kā ES dalībvalsts, iekšējiem normatīviem aktiem, kā arī TRIPS līgumu.
Pētījuma rezultātā autors nonāca pie secinājuma, ka ACTA neievieš jaunu regulējumu intelektuālā īpašuma tiesību jomā ES, bet sabalansē to starp pārējiem līguma dalībniekiem, kas būtiski neietekmē brīvo pakalpojumu sniegšanu un apriti digitalajā vidē ES ietvaros.

The purpose of this bachelor thesis is to explore the possible change in regulatory and institutional framework of free services provision and movement within the European Union (EU), arising from concluding an Anti-Counterfeiting Trade Agreement (ACTA). The incisive discussions and protests this multinational agreement has caused all around the globe emphasize the relevance of the topic and the research question studied in this thesis. Analysis includes general information on the single digital market within the EU, an overview of the current regulation of e-commerce, accentuating its problem areas and the key development pillars outlined in the Digital Agenda for Europe. The analysis consists of a comparison of the key conditions of the treaty to the existing regulations on the EU level, to internal laws and regulations of Latvia as a member of the EU, and to TRIPS agreement. The study allows the author to arrive at a conclusion that ACTA does not introduce novel regulation in the field of Intellectual Property Rights (IPR) in the EU; however, it does balance IPR with other members of the treaty. This is not expected to have a significant practical impact on free services provision and movement within the EU.
