- ItemComparative analysis of the Latvian and ECtHR case law concerning defamation and hate speech(Riga Graduate School of Law, 2018) Grebņovs, Eduards; Andguladze, Mamuka; Riga Graduate School of LawThe aim of this research is to analyse case law of European Court of Human Rights and courts of Latvia concerning the limitation grounds of freedom of expression, more precisely- hate speech and defamation. The analysis of the cases is crucial, since all of the Member States are kindly invited to follow the particular recommendation, which is issued by the Committee of Ministers as well, as the case law of Strasbourg Court obliges Member States to follow the European standards in relation to the restriction of freedom of expression. Thus it will show, whether Latvia has translated these standards.
- ItemHate speech as limitation to freedom of expression(Riga Graduate School of Law, 2018) Sedols, Roberts Kārlis; Andguladze, Mamuka; Riga Graduate School of LawThe aim of the thesis is to provide a reasonable solution for the absence of a definition of hate speech, which could be applied within the case law of European Court of Human Rights concerning freedom of expression. The problem arises as a result of the ambiguity of “hate speech” as it has no universal definition, therefore creating a legal problem – when the right to freedom of expression is exercised and leads to legal consequences where the interpretation of freedom of expression is uncertain, in some cases it is unclear whether the expression constitutes as a hate speech or not.
